| General
Regulations of the Austrian Bookmakers' Association |
|
|
1. All betting contracts shall be subject only
to the following betting regulations, insofar as they do not contravene
mandatory legal regulations. The relevant Austrian legal regulations
may help to clarify the relationship of the various parties of
these contractual regulations.
2. The parties to a bet are, on the one hand, the
bookmaker who, pursuant to the official license granted, is authorized
to accept bets placed on sporting events and, on the other, the
betting client. The bets are offered and made on the occurrence
of certain betting events determined by the bookmaker before the
conclusion of the contract, which relate to sports events.
3. By placing a bet, the betting client explicitly recognizes
the validity and applicability of the betting regulations and
confirms that he/she has read them and understands their full
content, before placing a bet. These betting regulations are to
be clearly posted in the betting office.
4. The betting client declares that he/she has reached the minimum
age to participate in a betting contract, as required by the legal
regulations where the contract is concluded, and that he/she does
not have any previous knowledge of the outcome of the sporting
event that is the subject of the relevant bet, before the contract
is concluded. He/she further guarantees that the means used to
defray the cost of the bet did not originate from any unlawful
act and are at his/her free disposal.
5. The betting client declares that he/she agrees that the bookmaker
shall at all times be entitled to refuse to accept a bet without
stating a reason, to limit the stake of a bet before accepting
it and to change the odds before a bet is concluded.
6. Personal bets are deemed made with legal effectiveness upon
delivery of the betting form to the betting client and complete
payment of the betting stake. The records of the bookmaker shall
be decisive for all bets. Upon acceptance of the betting form,
the betting client shall review its correctness and make immediately
any objections, if applicable. Later objections will not be taken
into account. The betting form may only be corrected in order
to remedy an evident and clear mistake of the betting client,
such as a clerical or computational error, and if such allowable
correction is entered in the records of the bookmaker. Any other
contestation of the betting contract on any legal grounds is excluded.
7. A betting contract once concluded can only be cancelled or
modified upon common agreement between the betting client and
the bookmaker by means of a corresponding note in the bookmaker's
records. Once a betting contract has been concluded, the betting
client has no unilateral right to cancel the agreement.
8. Unless anything different has been explicitly agreed, such
as in the case of telephone bets or bet contracts using other
means of communication, payment of the winnings is exclusively
made against the return of the original betting form. There is
no issue of substitute betting forms or a blockage on winnings
for any stolen or otherwise lost betting forms. Only clients who
present the original betting form to the bookmaker are entitled
to receive possible winnings from the bookmaker. The bookmaker
has no liability of whatsoever type for the loss of the betting
form.
9. If the betting forms are not furnished within 60 days from
the start of the deadline, the betting client's claim for payment
lapses, independent of the reason for any non-observance of the
deadline. The deadline starts to run at 0.00 hours of the first
day after the termination of the betting event. The bookmaker
may reserve payment of the winnings up to 14 days after the presentation
of the betting form.
10. The principle "the ticket talks" shall apply, which
means that the content of the betting contract is determined by
the entries on the betting form, unless the odds, the commercial
mailings, written odds information or other reasons indicate that
the entries made in the betting form (with respect to odds or
amounts) are based on a fault of the bookmaker. In this case,
the bookmaker shall be entitled to correct the content of the
betting contract at the latest upon any payouts (e.g. through
a correction in the odds or the payment amount). The bookmaker's
right to avoidance of the contract on account of a mistake (Article
871 ABGB) shall not be affected.
11. The betting client is not entitled to, whether with or without
remuneration, to assign, pledge or otherwise legally dispose of
any claims he has against the bookmaker under betting contracts
or to offset such claims with claims of the bookmaker.
12. The place of jurisdiction for all disputes arising out of
the betting contract shall be the competent court at the bookmaker's
place.
1. If the event that is the subject of a bet takes place other
than indicated in the odds sheet (e.g. if the right to play at
home was exchanged), the bet shall be void and the stakes are
refunded. However bets will keep their validity if the home team
refuses its right to play at home and is willing to carry out
the game at another sports ground.
2. If a bet for whatsoever reason is placed after
the start of the relevant betting event or is not made in accordance
with the relevant betting regulations, the bet shall be void and
the stake shall be returned to the client. But this does not apply
to bets which, based on their type, are explicitly offered by
the bookmaker even after the start of the betting event, such
as a hurdle race, long-term bets and live bets. The bookmaker
is entitled to enter the time of the acceptance of the bet in
the records with binding effect for the betting client.
3. The results announced immediately after the end of a sporting
bet event (e.g. Formula 1 > ceremony) shall always be the results
decisive for the evaluation of a bet as won or lost. Any later
changes in the ranking (e.g. due to decisions made on the "green
table") do not influence the evaluation.
4. For bets on soccer, the result is decided at the end of 90
minutes (regular playing time), for ice hockey games at the end
of 60 minutes (regular playing time). Any overtime or penalty
shoot-outs, etc. will not affect the betting contract, unless
the parties to the contract have agreed otherwise by making a
note in the bookmaker's records (e.g. European Cup games).
5. If a betting event is cancelled or interrupted or ends without
an official score or is not held or is held at a date other than
the original date for any other reasons, the stakes will be refunded,
unless a) a substitute date for the event has been set within
the following two calendar days, computed from the originally
planned start of the event, or b) the game is played later within
the context of the same tournament (e.g. World, European or National
Championships, Olympic Games, tennis tournament, etc).
All times indicated relate to Central European Time (CET).
6. If a betting event is interrupted but officially rated, the
bet shall be maintained and Point 3 shall apply accordingly. A
tennis game, terminated as described above, is deemed as not held
so that the stakes will be refunded.
7. If there are two identical competitions (e.g. ski giant slalom)
at the same location, all bets placed before the beginning of
the first event shall apply to this first event, unless explicitly
defined otherwise.
8. Bets are paid out under consideration of the prevailing bookmaker
limits. In the case of a "Dead-Heat", the payouts are
divided accordingly (e.g. 2 winners: half of the stake is won,
half is lost, so, for example, odds 3.0 becomes 1.5 or 1.6 becomes
0.8!).In competitions, where only 2 starters (teams) participate
(duel, e.g. training duel or team sports with even handicap) and
no tie odds are offered, the stakes are refunded in the case of
a "dead heat".
9. The rule of "play or pay" is valid for all bets.
This means that for any bets on a competitor who does not take
part in an event, independent of which reason, the bet is lost,
if the event, for which the starter or the team was listed, actually
takes place.
10. If in a bet, in which several betting events are combined,
one or several of the events are cancelled or interrupted or do
not take place for any other reason, without the event being rescheduled
within the sense of Point 5 above, such betting events are assigned
odds of 1.0. If, in a combo bet, all betting events are cancelled
or interrupted or do not take place for any other reasons, without
a later game within the sense of Point 5 is held, the stakes are
returned. If a bet, which combines several events, is concluded
after the start of one or several of these betting events, the
events will be assigned odds of 1.0. But this does not apply to
bets which, based on their type, are explicitly offered by the
bookmaker even after the start of the betting event (e.g. hurdle
races, long-term bets and live bets, etc.).
For other betting contracts concluded in a non-personal and indirect
way via means of communication (e.g. telephone, fax, letter, email
or the Internet), these betting regulations shall apply accordingly,
unless explicitly determined otherwise.
Any supplementary regulations for such types of betting contracts
shall be announced separately and bindingly by the bookmaker (for
example by mail, email or on his homepage).
| Minimum
stakes and winning limits |
|
|
The right to establish minimum stakes and limits on winnings is
reserved for the bookmaker and is separately listed in the general
terms and conditions.
These betting regulations resolved by the Austrian Bookmaker's
Association enter into force on 1 May 2001 at 00.00 hours, at
which time all previous versions issued by the Association shall
become null and void.
1. The Additional Regulations shall apply in addition to the General
Regulations.
2. When placing a bet, the betting client explicitly declares
that he/she has read, recognized and understood in full the notes
on the homepage, the Legal Regulations and these Additional Regulations.
3. When placing a bet, the betting client declares that the placement
of bets is not prohibited at the place, from where he/she enters
the bet on the Internet and that he/she has full knowledge of
all applicable legal regulations. laudabet.com shall not be liable
for any disadvantages, which are incurred by the bettor through
a violation of legal prohibitions in the country, in which he/she
enters the bet on the Internet.
4. For any bets concluded via the Internet between the betting
client and laudabet.com, it is necessary to use the codes entered
by the client (user name and password). The bookmaker does not
assume any liability for any misuse or incorrect use of a betting
account through unauthorized persons via the Internet using the
indicated name and password. It is explicitly pointed out that
the user name and the password must be kept strictly confidential.
All account movements, which use these codes, are on the betting
client's account.
5. laudabet.com does not assume any liability for damage that has
been incurred due to a delayed, faulty or failed data transfer
via the Internet.
6. The valid conclusion of a bet via the Internet requires a
positive balance in the betting account to at least the amount
of the betting stake. Bets are only accepted, if the entire stake
has been credited to the relevant client account of laudabet.com
before the start of the sporting event, forming the basis of the
event.
7. A bet becomes valid, as soon as a corresponding confirmation
has been received and the stake has been debited from the betting
account.
8. laudabet.com is entitled to adjust any obvious mistakes in the
client account.
9. The betting client agrees that any telephone calls with him/her
may be recorded on tape and retained and that he/she may receive
promotional material by laudabet.com via email, fax or mail.
10. Odds sheets are not mailed separately and can
be viewed by the betting client on the Web page of laudabet.com.
Please observe that no responsibility is accepted for any odds
information displayed there.
11. laudabet.com can refuse to open a betting account for any applicant
wishing to do so without stating a reason.
12. The betting client acknowledges that the data entered by
him during the registration is correct and complete and agrees
that this data is stored and processed exclusively within the
context of the betting operation.
13. For American sport types (MLB, NBA, NFL, NHL), a delay of
more than 12 hours is regarded as a cancellation of the game.
Such games are assigned odds of 1.0.
14. Formula 1 / Motor sports:
First retirement: In the case of more drivers retiring at the
same time (e.g. accident), the odds are divided. In the case of
a start collision, those drivers will be regarded as retired,
who do not join the restart.
Retirement: The driver who has passed less than 90 % of the entire
race distance is regarded as retired.
No retirement: The driver who has passed more than 90 % of the
entire race distance is regarded as not retired.
15. Head-to-Head bets: If, in a head-to-head bet, both starters
retire, the stakes are refunded.
16. For payouts from the client account, which were only preceded
by the deposit without placing a bet, we have to charge the full
transfer fees and additional processing fees from the client.
17. The betting client agrees that client data, which relates
to bookings and bets placed, is deleted within a period of approximately
6 months. For this reason laudabet.com recommends printing out and
retaining this data at regular intervals.
18. Any correspondence with laudabet.com can be
made in the German and English languages.
